1. Parties
- CREACTİVE TEKNOLOJİ SAN. VE TİC. A.Ş., headquartered at Kızılırmak Mahallesi 1445. sok. No:2/1 The Paragon Tower B Blok K:23 İç Kapı No 113, Çukurambar/Çankaya/Ankara, operator of the website www.idleinstock.com (hereinafter referred to as "IdleInStock").
- The internet user who registers as a member on the website www.idleinstock.com ("Member")
2. Subject of the Agreement
The subject of this Agreement is the determination of the conditions under which the Member may benefit from the website www.idleinstock.com owned by IdleInStock.
3. Rights and Obligations of the Parties
3.1. The Member declares and undertakes that the personal and other information provided when registering on www.idleinstock.com is accurate under the law, and that they will immediately and fully compensate all damages suffered by IdleInStock due to the inaccuracy of such information.
3.2. The Member may not share the password given by IdleInStock with any other person or organization; the right to use the password belongs exclusively to the Member. IdleInStock reserves all rights to claim compensation and other remedies for any unauthorized use of the password.
3.3. The Member accepts and undertakes from the outset to comply with all applicable legal regulations and not to violate them when using the website www.idleinstock.com.
3.4. The Member may not use the website www.idleinstock.com in any manner that disrupts public order, is contrary to public morality, disturbs or harasses others, violates the law, or infringes on the intellectual and copyright rights of others.
3.5. The ideas and opinions expressed, written, or used by members on www.idleinstock.com are entirely the personal views of the members and are binding on the opinion holder. These views and opinions have no connection or relation to IdleInStock.
3.6. IdleInStock shall not be responsible for the reading of member data by unauthorized persons or for damages that may occur to member software and data. The Member has agreed in advance not to claim compensation from IdleInStock for any damages that may be suffered due to use of the website.
3.7. The Member has agreed not to access or use the software and data of other internet users without permission.
3.8. A Member who violates one or more of the provisions of this Membership Agreement shall be personally responsible for such violation in criminal and civil terms, and IdleInStock shall be indemnified from the legal and criminal consequences of such violations.
3.9. IdleInStock has the right to unilaterally cancel a Member's membership and delete files, documents, and information belonging to the Member in cases of non-compliance with established rules or in adverse circumstances.
3.10. The software and design of the www.idleinstock.com website are the property of IdleInStock, and related copyright and/or other intellectual property rights are protected by applicable laws and may not be used, acquired, or modified by the Member without permission.
3.11. IdleInStock may collect certain information such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site for the purpose of improving and developing the website and/or within the framework of applicable legislation.
3.12. IdleInStock may use members' personal information to provide better service, improve its products and services, and facilitate use of the site tailored to users' personal preferences and interests.
3.13. A person who becomes a member of IdleInStock declares and accepts that they permit IdleInStock to offer them product and service promotions, advantages, surveys, and other customer satisfaction activities. The Member declares and accepts the collection, sharing with all affiliated companies, use, and archiving of personal and shopping information for the above purposes.
3.14. IdleInStock may disclose the Member's personal information when legally required or when it in good faith believes it is necessary to comply with legal requirements or legal processes served on IdleInStock, or to protect the rights and property of IdleInStock.
3.15. Measures have been taken within available means to ensure the IdleInStock website is free from viruses and similar malicious software. However, users must still obtain their own virus protection system and ensure adequate protection.
3.16. IdleInStock may modify, update, or cancel the conditions of the Membership Agreement. Each modified, updated, or repealed provision shall take effect for all members on the date of publication.
3.17. The Parties accept and declare that all computer records belonging to IdleInStock shall be accepted as the sole and authentic exclusive evidence and constitute an evidentiary agreement.
3.18. IdleInStock is authorized to send informational e-mails to the registered e-mail addresses of its members and informational SMS messages to their mobile phones. By accepting this Membership Agreement, the Member is deemed to have consented to receiving such communications.
4. Termination of the Agreement
This Agreement shall remain in force until the Member cancels their membership or IdleInStock cancels the membership. IdleInStock may unilaterally terminate the Agreement by canceling the Member's membership if the Member violates any provision of the Membership Agreement.
5. Dispute Resolution
The Courts and Enforcement Offices of Ankara shall have jurisdiction over disputes arising from this Agreement.
6. Entry into Force
The Member's registration as a member signifies that the Member has read all provisions of the Membership Agreement and accepted the terms therein. This Agreement has been concluded and mutually entered into force at the moment the Member registers.
